Chapter 13 Bankruptcy FormsA Chapter 13 bankruptcy is often called the reorganization bankruptcy. It's usually filed by those who have sufficient income to be able to pay off their debts within a three to five year time period. A Chapter 13 bankruptcy will allow people to pay off their debts with enough left over for expenses.

Chapter 13 bankruptcy forms are available in a single PDF package containing multiple forms. The Voluntary Petition, Summary of Schedules, Statement of Financial Affairs, and Chapter 13 Statement of Current Monthly Income and Calculation of Commitment Period and Disposable Income are all included. Other required Chapter 13 forms include the Statement of Social Security Numbers, Declaration, and Credit Matrix Instructions.

You will need to include information about your creditors, the nature of the debts, and the total amount you owe. You will also need to note the source, frequency, and amount of your income and a list of your property. Finally, you will need to detail your monthly living expenses, including housing, transportation, utilities, food, insurance, medication, and others. This information must be filed at the same time as your Voluntary Petition.

Depending on your filing status and circumstances, you may need to file other forms along with your standard Chapter 13 bankruptcy form. If you need a waiver, a time extension, or need to pay your fees in installments, or are using a non-attorney preparer, you will need supplemental forms. These should be filed separately but at the same time as your Voluntary Petition.

If you do not have all the information necessary to file your documents at the same time, you may file a "bare bones" Chapter 13 bankruptcy form first. This will begin the bankruptcy process, but the remaining documents in the schedules packages must be filed within 14 days, or your case will be dismissed.

Once your Chapter 13 bankruptcy forms are filed, they automatically stay, or stop, most collection efforts against your property. This stay requires no action on the part of the court, and most of your creditors will not be able to garnish your wages, initiate lawsuits, or continue collection efforts against you. The automatic stay will protect you and your co-debtors. However, the stay may be temporary in some situations.
